Rules

Read these rules and conditions carefully as they govern all bets accepted by us.

DEFINITIONS:

  1. In these Rules, the following words and expressions shall have the meaning hereby assigned to them, respectively, unless there is something in the subject or context in­ consistent with such construction or unless it is therein otherwise expressly provided:

(a) “Bet” means an offer which has been accepted by the Company in accordance with the provision of these Rules

(b) “Branch” means any place of business of the Company

(c) “Branch Manager” means any person authorized in writing by the Company to receive or negotiate bets in the branch at which the offer to make the bet is made

(d) “Company” means Capital Betting & Wagering Limited

(e) “Head Office” means the registered Office of the Company at 86 Half Way Tree Road, Kingston 10 or such other place as may for the time being be the registered Office of the Company

(f)  “Locked bag” means a specially manufactured container with an apparatus for recording the time at which it is locked and which is supplied by the Company to branches

(g) “Microfilm unit” means the security microfilm or facsimile equipment supplied by the Company to branches for filming and recording the security copy

(h) “Security copy” means that copy of the voucher which, pursuant to the Betting,

Gaming and Lotteries Regulations, 1975., is retained by the Company

(i) “Computerised system” means the company’s computerised system of accepting an offer to bet as approved by the Betting, Gaming & Lotteries Commission and as evidenced by a bar encoded ticket.

j) “The Company’s programme” means the publication by the Company bearing the Company’s Logo and setting out the races on which offers may be made to the Company of bets and the type of bet which may be contained in such offer

(k) “Voucher” means the original voucher written up containing particulars of the offer which the person offering to make the bet makes to the Company.

(l) “Winnings” means the difference between the amount to be paid-out and the amount staked on any particular winning bet.

General Rules

  1. It is a basic condition of the writing up and the acceptance of every voucher or copy of a voucher or a bar encoded ticket and the basis of any agreement, arrangement or transaction concerning or affecting the acceptance of any bet by the Company and of any­ thing done in connection therewith and all arrangements relating thereto (whether mentioned in these Rules or to be implied) that the same is governed by these Rules. Every person by or on whose behalf a voucher/bar encoded ticket is written up shall be deemed to have read these Rules and to have accepted as a condition of his offer to bet being accepted by the Company the terms and conditions set out therein.

 

  1. (1) When

(a) one of the Company’s betting vouchers has been written by or on behalf of a person and has been signed by a Branch Manager or accepted by the company’s computerised system, and

(b) the amount of the money staked has been paid to the Branch Manager in accordance with Rule 10, the same shall constitute an offer by the person by whom or on whose behalf the voucher was written to make a bet with the Company on the event as written on the voucher or as evidenced in the bar encoded computerised ticket.

(2) The offer may be accepted by the Company

(a) at a branch where there is a microfilm or facsimile unit by filming and recording on microfilm by means of the microfilm unit the security copy or by sending a facsimile copy to head-office or by issuing a bar encoded ticket;

(b) at a branch where there is no microfilm or facsimile unit or computer, by placing the security copy in a locked bag and locking the bag.

  1. (1) Notwithstanding any of the provisions of Rule 3 of these Rules, a bet shall be void and shall give rise to no liability

(a) in a case where the security copy is filmed and recorded on microfilm by the microfilm unit where the microfilm discloses that the microfilm recorded was not made at or before the relevant time or where the security copy is sent via a facsimile machine where it is recorded that it did not reach at or before the relevant time or where there is a breakdown in the company’s computerised system or the company’s computer shows that the bet was placed after the relevant time;

(b) in a case where the security copy is not filmed and recorded as aforesaid where the locked bag is unlocked at the Head Office and either no security copy is found therein or the timing apparatus on the locked bag discloses that the locking of the bag did not take place at or before the relevant time;

(c)

(i) Local Racing

For Local Racing, where a bet or series of bets totaling $2000- or more in the case of single horses or $500- or more in the case of accumulators, quinelas, exactas, double events, trifectas, dual & straight forecasts, etc. is placed at a branch and the branch manager does not inform the head office of the Company before the first of the relevant race so involved.

(ii) English Racing

For English Racing, where a bet or series of bets totaling $1000- or more in the case of single horses or $250- or more in the case of accumulators, quinelas, exactas, double events, trifectas, dual & straight forecasts, etc. is placed at a branch and the branch manager does not inform the head office of the Company before the first of the relevant race so involved.

2. In paragraph (1) of this Rule the expression “relevant time” shall be the latest time fixed by the Company’s programme for the acceptance of offers in respect of the earliest of the races listed on the security copy or bar encoded ticket.

 

3. It is a condition of the acceptance of any bet which has been accepted by recording on the microfilm or sent via a facsimile machine or issued by the company’s computerised system that in the event of any dispute arising out of any bet or offer to make a bet and in any legal or arbitration proceedings or investigations a statement contained in any microfilm record of a security voucher shall be admissible as evidence without formal proof of the microfilm record or a statement that it was not received at Head Office at or before the relevant time or printed by the company’s computerised system shall be conclusive and overriding evidence of the voucher bearing the same numerical sequence as appears on the said microfilm or facsimile record or computer printout and of the contents thereof and of any fact stated therein, including, without derogating from the generality of the foregoing, conclusive evidence of each bet contained in the said voucher and as to the time of acceptance hereof.

 

4. It is a condition of the acceptance of any bet which has been accepted by placing the security copy in a locked bag and locking the bag that in the event of any dispute arising out of any bet or offer to make a bet in any legal or arbitration proceedings or investigation the time recorded on the timing apparatus shall be conclusive evidence as to the time at which the locking of the bag took place.

 

5. Offers will not be accepted from any person under the age of eighteen years or from any agent or from any servant or agent or Branch Manager of the Company or from any person who is acting on behalf of any such person who is here-in-before mentioned in this Rule or in partnership or combination with any such person. Notwithstanding the provisions of Rule 3 hereof any offer to make a bet made by any person who is referred to in this Rule shall be void and incapable of acceptance.

 

6. Any offer to make a bet may be made only for those races specified in the Company’s programme for the day on which each such race is scheduled to be run. Such an offer as aforesaid may be made only for a bet of the nature specified in the Company’s programme in respect of each such race. Notwithstanding the provisions of Rule 3 hereof any offer to make a bet which does not comply with the Rules shall be void and incapable of acceptance.

 

7. The Company will not be responsible for any inaccuracy or omission on the Company’s programme. The Company reserves the right to rectify clerical errors.

 

8. The voucher/bar encoded ticket shall constitute the terms of the offer to make the bet therein stated. It is the sole responsibility of the person by or on whose behalf the offer to make the bet with the Company is made to ascertain that his requirements have been accurately recorded to his satisfaction by carefully checking the voucher/bar encoded ticket by whomsoever written. It is a term and condition of any contract between the offeror and the Company that may result from the submission by the offeror to the Company of the security copy that results in the making of the offer for acceptance by the Company that the client warrants to the Company that the security copy is an accurate copy of the voucher/bar encoded ticket and that the voucher/bar encoded ticket accurately expresses the terms of the bet which he offers to make with the Company. The Company notwithstanding any acceptance by it of an offer to bet which has been made to it shall have the sole right to deem null and void any portion or portions of the voucher/bar encoded ticket that may be illegible or which contains any ambiguity or if the Company is not satisfied with the bona tides of any person involved in submission of the voucher/bar encoded ticket which gives rise to the offer by an offeror to make a bet with the Company.

 

9. In every case where the security copy is transmitted to the Head Office in a locked bag, the locked bag will be opened by the Company at the Head Office. In every case where the security copy is recorded on the microfilm unit and the microfilm record is transmitted to the Head Office the container in which the microfilm record is placed will be opened by the Company at the Head Office. If the security copy is not present in the locked bag or if the microfilm record is not in the container, as the case may be, no contract and no bet shall exist between the Company and the holder of the voucher and in such circumstances the Company will, upon presentation of the voucher at the Head Office within thirty days of the date of the event to which the voucher relates, repay the amount staked.

 

1O.  No offer to bet shall be complete and capable of acceptance unless and until there shall have been paid to the Branch Manager, who signs the voucher relating there-to before or at the time of the signing of the voucher by the Branch Manager, the amount of money staked according to the terms contained on the voucher and in the Rules.

 

11. Maximum Winnings

(a) There are no maximum dividend payable on any horse or combination of horses on which dividends are paid by the local promoters as carried by the company and as set out on the Company’s programmes on a daily basis, save and except that on trifectas on which the limit is 250:1

(b) There are no maximum odds on all bets on Overseas Racing.

(c) This applies on all bets legitimately bought via the company’s computerised or paper voucher systems.

(d) The maximum winnings on any one voucher shall be Two Hundred Thousand Dollars ($200,000.00) on tickets bought via the company’s computerised system and One Hundred Thousand Dollars ($100,000.00) on all paper voucher bets.

 

12. In any Accumulator bet, the client loses so soon as one of the Horses named by him in the voucher/bar encoded ticket fails to Win or Place as the case may be.

 

13. Accumulator bets will be calculated to the dollar (one-tenth of a ticket) provided that any amounts less than a dollar (one-tenth of a ticket) will not be taken into account in the calculations.

 

14. Any claim for payment of winnings or for a refund of stakes must be made to the Company within thirty (30) days after the day on which the race or races were run or were scheduled to be run, as the case may be. In order to entitle a client to any such payment or refund the client must present and surrender to the Company the voucher/bar encoded ticket in respect thereof. After the expiration of any such period of thirty (30) days, the Company will be under no liability to make any payment or refund in respect thereof.

 

15. Where in any offer there is no express statement as to whether the offer relates to a Win bet or a Place bet, the offer will be interpreted as an offer of a Win bet.

 

16. Where in any offer the amount specified as the total stake is different than the amount specified as the unit stake taken with the number of bets written in the offer, the offer will be interpreted as an offer to bet on the selections specified and in the manner specified but the number of bets will be changed in proportion to the amount that should have been the total staked.

(a) The minimum unit stake is ten (10) dollars while the minimum stake per voucher/bar encoded ticket is ten (10) dollars.

(b) This amount may be superseded by a notice displayed in a branch.

17. a) Forecasts/Quinelas

Where the pool conducted at the track on which the race is run declares no Straight Forecast or Quinela Dividend as the case may be or where a Straight Forecast or Quinela Dividend is declared on a Combination other than the two Horses which have been placed in the first two places, in such case, the Company shall pay its maximum dividend on the actual winning combination. All other Combinations will be considered losing bets.

b) Trifectas

Where the pool conducted at the track on which the race is run declares no Trifecta Dividend or where a Trifecta Dividend is declared on a Combination other than the three Horses which have been placed in the first three places, in such case, the Company shall pay its maximum dividend on the actual winning combination. All other Combinations will be considered losing bets.

 

c) Capital Favourites

Bets on First Favourite, Second Favourite, Third Favourite and Fourth Favourite are accepted “Win Only” on Local Racing. Bets on all Favourites for Place are incapable of acceptance and the stake for the relevant portion of such bets will be refunded. First, Second, Third and Fourth Favourites are determined by the number of tickets sold on the win pool as determined by the Totalisator at the race course on which the race is run. The first favourite is the horse which returns the largest number of tickets sold on the win pool at the off-time of the relevant race. The second favourite is the horse which is returned at the next largest total number of tickets, and so on. Where two horses sell equal numbers of tickets, they become joint favourites and the odds are divided by two. For example, if two horses each sell the second largest number of tickets, they become joint second favourites. The horse which returns the next largest number of tickets then becomes the fourth favourite.

 

18. Where a bet specifies a Straight Forecast or Quinela bet on two Horses which are not engaged in the same race on the race day for which the bet is made, the bet will be interpreted as a Win Accumulator on the two Horses named.

 

19. In event of a race meeting being postponed, all bets for that meeting will be void. In the event of some of the races scheduled to be run at a race meeting being postponed all bets for each of the uncompleted races at the meeting will be treated as non-runners (see Rule 37).

 

20. Save as is provided in Rules 17 and 22 all bets will be paid to those who have made valid bets on the Horses or combination of Horses on which the Totalisator at the race course on which the race is run pays a dividend. Save as aforesaid, if the said Totalisator does not pay a dividend on any Horse or combination of Horses the bet with the Company is a losing bet.

 

21. Where a bet specifies a Place bet, whether Single or Accumulator on a Horse but no place pool is conducted on the race at the race course on which the race is run, the Horse so named must win and the place dividend will be considered to be the same as the win dividend in all calculations.

 

22. Unlimited offers to make place bets only will be accepted on all single horses, accumulators, RTC’s, OCB’s (RTC’s without singles) and perm bets. No win stake is required.

 

23. Save and except as provided in Rule 25 where a named selection is declared to start in two or more races on the same day and no race or an incorrect race is specified on the voucher the bet will be interpreted as a bet on the first race in which such Horse runs on the said day.

 

24. Where a named selection is specified on a voucher then the bet will be interpreted as a bet on the named selection notwithstanding that the race specified on the voucher may be incorrectly numbered or identified.

 

25. In an Accumulator bet to Win, if two or more of the Horses named on the voucher run in the same race, the portion of the bet naming the two or more Horses is void except where one or more of the Horses named is declared to start in another race scheduled to run on the same day in which case the bet shall be interpreted as a bet on such Horse in such other race.

 

26. Where more than one Horse is specified in a bet the bet will be interpreted as an Accumulator on all the Horses named in the bet unless the contrary is expressly stated on the voucher/bar encoded ticket.

 

27. Commissions at Ante-Post prices on Horse races run outside Jamaica will be executed at the best available odds at the time of receipt of the Commission on the basis of all in, run or not, enter or not. Commission at Ante-Post prices on Horse races run in Jamaica will not be accepted by the Company. Every offer of a bet on races run in Jamaica must be made at Totalisator odds.

 

28. Ante-Post bets on Horse races run outside of Jamaica will stand provided that the race is run whether on the day originally scheduled or on some other day.

 

29. Where a Dead-Heat is declared between two runners either of whom is the subject of an Ante-Post bet or bet at Starting Price in either case accepted by the Company, half the stake is lost and the full odds paid on the other half. Where more than two runners finish in a Dead-Heat this rule will apply in mathematical proportion to the number of Horses Dead-Heating.

 

30. The Company does not undertake to advise any client of any error in its instructions or any point which such instructions does not agree with any of these Rules.

 

31. Any amendment to these Rules shall be published in a daily newspaper printed and circulating in Jamaica and shall come into force and shall apply to all offers of bets made on or after the day immediately following the day of such publication as aforesaid.

 

32. Double Events

Where in any offer to bet on races run in Jamaica in which two Horses are named there is no express statement as to whether the offer relates to a Double Event bet or an Accumulator bet, the offer will be interpreted as an offer of an Accumulator bet.

 

33. Where a bet on races run in Jamaica specifies a Double Event bet but one or both of the races specified on the voucher/bar encoded ticket is not a race on which the promoter of the races in question is conducting Double Event betting the offer will be interpreted as a Win Accumulator on the Horses named.

 

34. Where

(a) an offer to bet on a race run in Jamaica specifies a Quinela or Trifecta bet, but the race specified on the voucher/bar encoded ticket is not a race on which the promoter of the race in question is conducting Quinela or Trifecta betting, as the case may be, the offer of the bet is incapable of acceptance by the Company and the amount staked will be refunded.

(b) an offer to bet on a race run in Jamaica specifies an Exacta bet, but the race specified on the voucher/bar encoded ticket is not a race on which the promoter of the race in question is conducting Exacta betting the offer of the bet is incapable of acceptance by the Company and the amount staked will be refunded provided however that where the promoter of the race in question is conducting Quinela betting, the offer will be interpreted as an offer of a Quinela bet.

 

35. Double Events

Where the pool conducted at the race track in Jamaica on which the races are run declares no Double Event Dividend or where a Double Event Dividend is declared on a Combination other than the two Horses which have won their respective races, in such case, the Company shall pay its maximum dividend on the actual winning combination. All other Combinations will be considered losing bets.

 

36. Where in regard to Jamaican racing, a mechanical Totalisator is used by the promoter of the race meeting at the race course on which the race meeting is being promoted, the fol­lowing Rules shall apply notwithstanding anything to the contrary in any other of these Rules:-

(a)  The “Field” shall bear the meaning contained in the Totalisators Rules for the time being in force as approved pursuant to the Third Schedule of The Betting, Gaming and Lotteries Act;

(b) “Starter’s Orders” shall bear the meaning contained in the Jamaica Racing Commission Racing Rules, 1977 or in any Racing Rules amending or replacing the same;

(c) If a Horse named in a bet is grouped in the Field such bet shall be a bet on all the Horses grouped in the Field;

(d) If a Horse named in a bet is grouped in the Field and does not come under Starter’s Orders, the bet will be “on” provided the field has at least one actual starter; Grouping the “Field” does not apply to Ante-Post bets. The actual horse named in the bet must Win or be Placed, as the case may be, in order that the client may win the bet.

 

37. Non-Runners Where

(a) a bet is a Double Event or Quinela or Exacta or Straight Forecast or a Doublet and is made at Starting Price or at Totalisator odds and one of the Horses named in such bet is a non-runner who does come under Starter’s Orders then, save as is mentioned in Rule 36, the bet will be treated as a bet to Win on the other Horse named in the bet.

(b) a bet is an Accumulator and is made at Starting Price or at Totalisator odds and one or more of the Horses named in such bet is a non-runner, who does not come under Starter’s Orders then, save as is mentioned in Rule 36, the bet will be treated as an Accumulator on the other Horses named in the bet as if the said non-runners had never been named therein.

(c) a bet is a Trifecta and is made at Starting Price or at Totalisator odds and one or more of the Horses named in such bet is a non-runner, who does not come under Starter’s Orders then, save as is mentioned in Rule 36, the bet is incapable of acceptance by the Company and the relevant amount staked will be refunded.

 

38. All winnings and dividends are subject to any deduction authorized from time to time by the Government of Jamaica or the Jamaica Bookmakers’ Association.

 

39. All bets on Overseas racing will be executed at Starting Price unless otherwise expressly requested in writing by the client and expressly agreed to by the Company. In any instance where the bet is executed at Starting Price but no Starting Price is returned, the bet will be treated as having been made at Totalisator odds. Where it is expressly agreed that any bet on United Kingdom or Irish Racing will be executed at Totalisator odds but no official Totalisator dividend is declared, the bet will be treated as having been made at Starting Price.

 

40. An offer of a bet on a Tricast may be made only on races run outside of Jamaica but will only be accepted if made at Starting Price. Where an offer of such a bet is accepted by the company and one of the Horses named in such bet is a non-runner who does not come under Starter’s Orders then the bet will be treated as a Doublet bet. In any such case as aforesaid if two of the Horses named in such a bet are non-runners who do not come under Starter’s Orders then the bet will be treated as a bet to Win on the remaining named Horse.

41. In Overseas Racing

(a) there will be no Dual Forecast betting on any race, no Straight Forecast betting on races with less than three (3) runners, no Quinela betting on races with less than four (4) runners, and no Tricast or Trifecta betting on races with less than nine (9) runners. Any purported offer or acceptance of such a bet will be void and of no effect;

(b) there will be no Straight Forecast betting on races with four (4) or more runners. Any purported offer or acceptance of such a bet will be void and of no effect;

(c) there will be no Doublet betting on any race whatsoever. Any purported offer or acceptance of such a bet will be void and of no effect.

(d) for the purposes of this Rule, the number of runners in any race shall be the number of runners listed for such race on the Company’s programme.

 

42. In United Kingdom or Irish Horse Racing, subject to Rule 38 and 44 winning Place bets at Starting Price will be paid at one-fifth of the Starting Price on a Win bet for each of the first three places if eight or more runners come under Starter’s Orders in the race and one­ quarters of the Starting Price on a Win bet for each of the first two places if six or seven runners come under Start’s Orders. Where on any Place bet at Starting Price there are less than six runners who come under Starter’s Orders in the race, the bet will be treated as a bet to Win.

 

43. In a Handicap race in United Kingdom or Irish Racing where there are sixteen or more runners who come under Starter’s Orders, winning Place bets at Starting Price will be paid at one-fifth of the Starting Price on a Win bet for each of the first four places.

 

44. In United Kingdom or Irish Racing, the Starting Price and Totalisator odds will, for the purposes of these Rules be the prices and odds as appears from The Sporting Life news­ paper. In the event that any error is corrected in any issue of the Sporting Life newspaper bets will be settled at the corrected price or odds. The advertised time of a race will be that contained in the Sporting Life newspaper on the morning of the race.

 

45. In respect of a bet on United Kingdom or Irish Racing, in the event of an objection, such bet will be settled in accordance with the Rules of Betting as issued by Tattersall’s Committee from time to time.

 

PLEASE NOTE: These Rules hold good until further notice and all previous Rules are hereby canceled.
